By accessing or using Zapforms ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you don't agree to these Terms, do not use the Service.

2. Description of Service

Zapforms provides a form building platform with API access, webhooks, and data management capabilities. We reserve the right to modify, suspend, or discontinue the Service at any time.

3. Account Registration

  • You must provide accurate and complete information
  • You are responsible for maintaining account security
  • You must be at least 13 years old to use the Service
  • One person or legal entity may maintain no more than one free account

4. Acceptable Use

You agree not to:

  • Use the Service for illegal purposes
  • Violate any laws or regulations
  • Infringe on intellectual property rights
  • Transmit malware or malicious code
  • Attempt to gain unauthorized access
  • Interfere with or disrupt the Service
  • Use the Service to send spam
  • Collect personal information without consent
  • Resell or redistribute the Service without permission

5. Content and Data

Your Content

  • You retain ownership of content you create
  • You grant us a license to use your content to provide the Service
  • You are responsible for your content's legality and accuracy

Data Processing

  • We process data according to your instructions
  • You are the data controller for form submissions
  • You must comply with applicable data protection laws

6. Payment Terms

  • Paid plans are billed monthly or annually
  • Payments are non-refundable except as required by law
  • We may change pricing with 30 days notice
  • You authorize automatic renewal of subscriptions
  • Failure to pay may result in service suspension

7. Service Limits

Free Plan

  • 3 forms maximum
  • 100 submissions per month
  • 100 API requests per minute

Pro Plan

  • Unlimited forms
  • Unlimited submissions
  • 1000 API requests per minute

8. API Terms

  • API access is provided "as is"
  • You must not exceed rate limits
  • API keys must be kept confidential
  • We may modify or deprecate APIs with notice

9. Intellectual Property

  • The Service and its content are protected by copyright
  • "Zapforms" is our trademark
  • You may not copy or redistribute our code or designs
  • You retain rights to your content

10. Privacy

Your use of the Service is subject to our Privacy Policy. Please review it to understand how we collect and use information.

11. Warranties and Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZAPFORMS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES.

13. Indemnification

You agree to indemnify and hold harmless Zapforms from any claims arising from your use of the Service, violation of these Terms, or infringement of any rights.

14. Termination

  • Either party may terminate at any time
  • We may terminate for Terms violations
  • Upon termination, your right to use the Service ceases
  • You may export your data before termination

15. Modifications to Terms

We may modify these Terms at any time. We will notify users of material changes. Continued use after changes constitutes acceptance.

16. Governing Law

These Terms are governed by the laws of [Jurisdiction], without regard to conflict of law principles.

17. Dispute Resolution
